New Cold War, June 3, 2015

I learned today that the High Specialized Court of Ukraine for Civil and Criminal Cases confirmed earlier decisions of the Lutsk court and the Volyn court of appeals which de facto deprived me of my house and my personal property in the Volyn Region. The same high court previously ruled that there were sufficient reasons to regard these decisions of the lower courts as illegal.
In the past 20 years, I spent most of the summers and often other university breaks there to conduct my archival and field research on the OUN and the UPA and on the elections in Ukraine. Now, I won’t be able to do that for the first time because of these decisions and a real possibility of a much more serious retaliation.The latest ruling by the top Ukrainian court is another indication that my house, land, and personal items have been seized with help of courts as a result of political interference from the top in retaliation for my research on the mass murders by the OUN and the UPA in Volhynia [WW2 era], and the Maidan and Odesa massacres in 2014.These court decisions were based on openly false claims and a telephone order from the higher-ups to a Lutsk judge to reverse her own decision, which recognized me as a legal owner of the house. The courts falsely and brazenly ruled that not my late disabled mother and I but another person lived in the house, paid utility bills and had personal property there, even though my neighbors and documents testified to the contrary.The Lutsk and Volyn police, prosecutors, courts and other government agencies also do nothing in response to complaints from my lawyers on my behalf as my personal items are openly stolen, as my house and personal property are getting destroyed, and as my neighbors are illegally prevented from entering the house to heat and maintain it.The political interference from the top can explain such decisions by different judges and other officials, since they openly violate the law based on claims that are easily verifiable as false without any apparent concern for the consequences, specifically criminal, of their actions.There would not be any reporting in the mainstream media in Ukraine and the West and any reaction from the Ukrainian and Western governments.

A couple of weeks ago, the Maidan Self-Defence and Palytsia’s Order Guard, in the presence of SBU officers, top police officials, and journalists, tried to seize a house from a Lutsk judge who falsified my land court case during the Yanukovych government. He got his house for cheap with help of one of his rulings, a typical case in the highly corrupt justice system under Yanukovych.
I was able to overturn a land decision by that judge in an upper court. But the reason for the Maidan Self-Defence and Palytsia’s paramilitary unit action was that this judge issued rulings against some of their activists during the Euromaidan. Those court cases and the recent seizure attempt were widely reported by the local media, specifically Volynnews owned by Palytsia. But the media would not report that the head of the Volyn regional association of lawyers was personally involved in seizures of my house and land with help of falsification of court decisions, specifically in that case and similarly fraudulent case heard by another judge. The lawyer is closely associated with this Volyn oligarch, who served as the governor of the Odesa Region until a few days ago and was reportedly involved in organized crime in Lutsk in the 1990s.
This is another illustration how Maidan politicians and pro-Maidan oligarchs seized de facto control over the corrupt justice system as a result of the Maidan Massacre [Feb. 20, 2014], and that that the rule of law is unlikely in any foreseeable future.
